TERMS OF SALE. THE FOLLOWING TERMS OF SALE GOVERN THE PURCHASE OF ANY AND ALL PRODUCTS OFFERED
BY LBUTAMPA.COM ON THE WORLD WIDE WEB. READ THESE TERMS VERY CAREFULLY. THESE TERMS CONTAIN IMPORTANT
IFORMATION REGARDING THE PURCHASER’S RIGHTS AND OBLIGATIONS, AS WELL AS LIMITATIONS AND EXCLUSIONS
THAT MAY APPLY. BY PLACING AN ORDER, THE PURCHASER ACKNOWLEDGES THAT HE/SHE HAS READ, UNDERSTOOD,
ACCEPTED AND AGREED TO BE BOUND BY THESE TERMS, WITHOUT LIMITATION OR QUALIFICATIONS. THESE TERMS
ARE SUBJECT TO MODIFICATION WITHOUT PRIOR WRITTEN NOTICE AND AT ANY TIME IN LBU’S SOLE DISCRETION.
ADVERTISED PRODUCTS. We reserve the right to substitute any advertised product brand if the
advertised brand is unavailable at the time the order is placed. Any substituted product(s)
will be of equivalent quality and specifications of the product ordered. LBUTampa.com may
discontinue any product at any time without notice. The product prices displayed on this
Site do not include shipping and handling or sales taxes, if applicable, which may be
added to your total invoice price.
PRICE & ERRORS. Prices are subject to change without notice. LBUTampa.com makes every
effort in providing the most up-to-date and accurate information on our website and we are not responsible
for typographical or pricing errors however, if product price errors are discovered, they will be promptly
corrected and the corrected price will be applicable. LBUTampa.com will notify you if the order includes
items that were incorrectly priced and adjust the price accordingly.
SALES TAX. Customers are responsible for the payment of any state and local sales taxes
that may apply to their order. The sales tax is calculated based on the full invoice price, and may
include charges for shipping and handling if required by law. To comply with appropriate laws,
LBUTampa.com must collect sales tax for orders shipped to the state of Florida.
ORDERS. Orders are not binding on LBUTampa.com until acceptance is confirmed by
LBUTampa.com. LBUTampa.com reserves the right, without prior notification, to limit the order
quantity on any item and/or refuse service to any customer. Verification of information may be
required prior to the acceptance of any order.
CANCELLED ORDERS. All cancelled orders are subject to a processing fee. If an order
is cancelled after the customer has placed the order, or an incorrect payment is provided, a $15.00
processing fee will be deducted from the customer’s credit.
PAYMENT. VISA, MasterCard, American Express and Discover Card are accepted for payment
on your order. Your credit card will be charged at the time that the order is placed. New accounts
are subject to credit approval with a completed and signed Credit Application. Standard Terms are
Net 30. For customers who purchase on open accounts, LBUTampa.com reserves the right to add to your
monthly balance a service charge of 1.5% per month (18% annually) on all amounts unpaid on the first
day of the 2nd month following your purchase. If an account is turned over for collection to an
outside agency, the customer agrees to pay all costs and expenses of collection, including the
reasonable attorneys’ fees, in addition to the service charges stated above.
Insufficient funds fees (NSF) and returned check fees are the responsibility of the customer and are
subject to a minimum Return Check Fee of $25.00 per transaction.
SHIPPING & DELIVERY. On orders placed Monday through Friday by 2:00 PM Eastern Standard Time,
in-stock items ordered will be shipped that day via ground transportation to most locations.
Upgraded shipping service (Next Day & 2nd Day) are available at an additional charge. If only
part of the product ordered is in stock at the time the order is placed, the available product
will be shipped that day and the backorder will ship via Ground service with the stock is
replenished. Although LBUTampa.com will make all reasonable efforts to ship your order within
these time frames, it is not responsible or liable for any delay in receiving or completing
your order that is caused by an event beyond LBUTampa.com’s reasonable control. Shipping & Handling charges and any charged Freight are non-refundable in occurrences that
LBUTampa.com made no error in merchandizing or shipping.
LBUTampa.com ships via all major ground carriers, including FedEx, UPS and USPS.
Shipping and processing charges for all items are based on the item size, weight,
delivery destination, or other factors. A fee of $7.00 will be charged for orders totaling less than $100.00.
Higher shipping rates may be charged for over sized / overweight orders including fluorescent bulbs that are 20" or longer.
LBUTampa.com is currently offering complimentary shipping on orders totaling $100 or more
(excluding international shipments). Although the majority of orders to Alaska, Hawaii,
Puerto Rico, Guam and the Virgin Islands are included in this policy, LBUTampa.com may,
on occasion, need to assess additional shipping charges to these locations. If special
shipping arrangements are required for an order to one of these states or territories
the customer will be contacted first for approval.
If we are unable to contact the customer within five business days regarding additional
shipping charges the order may be cancelled by LBUTampa.com.
Rush delivery. Rush delivery is available on all orders received before noon, Monday
through Friday Eastern Standard Time for an additional charge.
Special Shipping & Handling Charges. Special shipping and handling charges will
apply for extremely large or heavy items. Re-pack charges will occur for fluorescent lamps
shipping in quantities less than a full case.
Mistaken Shipments. LBUTampa.com will replace the order and refund any applicable
shipping costs if it made an error with your order. LBUTampa.com may at any time limit the number of
delivery attempts based on unfavorable delivery history resulting from, but not limited to, damage,
loss, or theft.
LBUTampa.com will ship to Alaska, Hawaii, Puerto Rico, Guam and the Virgin Islands via
FedEx Express. The cost of this service will be determined at the time of shipping, based on
weight and dimensions of the product/container.
International Shipments. LBUTampa.com can ship internationally via FedEx Express
International Service. The cost of this service will be determined at the time of shipping, based
on weight and dimensions of the product/container. Estimated duties and fees will also be added to
the order. LBUTampa.com will not be responsible for breakage of light bulbs shipped outside of the
USA. Title and risk of loss of the products pass to the customer upon deliver at the “Freight Forwarder”.
BROKEN/DEFECTIVE PRODUCT. Please note any obvious damage or shortage while applying
your signature at the time of delivery. For damaged orders, keep the original box and all packaging
materials for possible inspection by the carrier and/or return to LBUTampa.com. To claim a defective
or broken product on a new order, the defective product must be reported within 5 days of receiving
the order. If you receive your product and it is broken or does not function as it should,
LBUTampa.com will replace the product at no charge.
RETURNED MERCHANDISE. No merchandise may be returned without a Return Merchandise
Authorization (RMA) number. Please call to obtain an RMA for any product you are seeking to return.
LBUTampa.com is not responsible for merchandise returned without an RMA number and credit will not
be issued for products that have been held for over 90 days from the date of the original invoice.
Returned products must include a copy of the original invoice, be in the original packaging and
in saleable condition. Returned product arriving broken or in crushed, stained, torn or marked
boxes will not be accepted. Merchandise that is returned due to overstock or customer ordering
error must be returned freight paid and may incur a restocking charge.
LIMITATION OF LIABLITY. TO THE MAXIMUM EXTENT ALLOWED BY LAW, LBUTAMPA.COM SHALL NOT
BE LIABLE FOR ANY SPECIAL, CONSEQUENTIAL, EXEMPLARY OR INCIDENTAL DAMAGES (INCLUDING LOST OR
ANTICIPATED REVENUES OR PROFITS RELATING TO THE SAME), ARISING FROM ANY CLAIM RELATING TO THESE
TERMS OF SALE, THIS SITE, THE CATALOG, PRODUCTS OR ORDERS, WHETHER SUCH CLAIM IS BASED ON WARRANTY,
CONTRACT, TOR (INCLUDING NEGLIGENCE OR STRICT LIABILITY) OR OTHERWISE. IN NO EVENT WILL THE COLLECTIVE
LIABILITY OF LBUTAMPA.COM EXCEED THE AMOUNT YOU HAVE PAID TO LBUTAMPA.COM FOR THE APPLICABLE ORDER OR
PRODUCT OUT OF WHICH LIABILITY AROSE. THESE LIMITATIONS SHALL APPLY NOTWITHSTANDING ANY FAILURE OF
ESSENTIAL PURPOSE OF ANY REMEDY. SOME STATES AND/OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR
LIMITATION OF INCIDENTAL OR CONSEQUENTAL DAMAGES, SO THE ABOVE EXCLUSION MAY NOT APPLY TO YOU.
GOVERNING LAW. The terms and conditions shall be governed by and construed in accordance
with the laws of the State of Florida applicable to contracts made and to be enforced wholly within the
State of Florida.
JURISDICTION AND VENUE. You, the customer, and LBUTampa.com irrevocably agree that any
legal action, suit or proceeding in any way arising out of these terms and conditions must be brought
solely and exclusively in the federal or state courts of the State of Florida located in the City of
Tampa, Florida.
SEVERABILITY. If any provision of these terms and conditions are held illegal,
unenforceable or in conflict with any law by a court of competent jurisdiction or arbitral tribunal,
such provision shall be deemed severed from these terms and conditions and the validity of the
remainder of these terms and conditions shall not be affected thereby.
